1. Purpose
This Agreement governs the sale of products through remote communication channels (online purchases) and sets out the rights and obligations of UZ Turk Mart ("Seller") and the customer ("Buyer").
2. Formation of Contract
A legally binding contract is formed when:
- The Buyer places an order through the Platform.
- Payment is successfully authorized and confirmed.
- The Seller issues an order confirmation via email or notification.
UZ Turk Mart reserves the right to refuse or cancel any order in accordance with its Terms & Conditions, including but not limited to cases involving suspected fraud, pricing errors, or stock unavailability.
3. Product Information
The Buyer acknowledges that:
- Product descriptions, quantities, and prices are displayed before checkout.
- All prices are shown in AED and include VAT unless otherwise stated.
- Product availability may vary, and unavailable items may be substituted or refunded where applicable.
4. Delivery Terms
Delivery terms are governed by the Delivery Policy published on the Platform.
Delivery times are estimates only and are not guaranteed. Risk and responsibility for products transfer to the Buyer upon successful delivery completion.
5. Cancellation
Buyers may request cancellation within 30 minutes of placing an order, provided the order has not been processed or dispatched.
If the order has already been processed or dispatched, cancellation requests will be subject to the Refund Policy and operational feasibility.
6. Returns & Refunds
Refunds, replacements, and dispute resolutions are governed by the Refund Policy published on the Platform.
Approved refunds will only be processed to the original payment method used for the purchase.
7. Perishable Goods
The Buyer acknowledges that certain products sold by UZ Turk Mart may be fresh, chilled, frozen, or otherwise perishable.
Once delivery has been completed, responsibility for proper storage and handling transfers to the Buyer.
Any quality-related claims must be submitted within the timelines specified in the Refund Policy.
8. Limitation of Liability
To the maximum extent permitted by applicable law, the total liability of UZ Turk Mart shall not exceed the total amount paid by the Buyer for the relevant order.
9. Governing Law & Jurisdiction
This Agreement shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
